Acceptance

By accessing or using vitalitoai.com (the “Site”) or opting in to receive messages from Vitalito LLC (doing business as Vitalito, “Vitalito,” “we,” “us,” or “our”), you agree to these Terms of Service. If you do not agree, do not use the Site or opt in to our messaging program.

The service

Vitalito provides patient booking and follow-up systems for clinics, including lead follow-up, patient reactivation, after-hours call answering, and related marketing services, along with a marketing website and call-booking process.

SMS Terms

Program description. The Vitalito messaging program sends (a) marketing messages about Vitalito’s services to clinic owners and staff who opt in, and (b) appointment reminders, booking confirmations, follow-ups, and promotional messages to the patients and leads of the clinics Vitalito serves.

How you opt in. You opt in by checking the consent box on a form at vitalitoai.com, or by texting START to our number. Consent to receive text messages is not a condition of purchasing any goods or services.

• Message frequency varies. Marketing messages are sent up to 4 times per month. Appointment reminders and confirmations depend on the appointments you book.
• Message and data rates may apply.
• Reply STOP to opt out at any time. You will receive one final message confirming you have been unsubscribed.

• The program is supported by all major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

Fees

Vitalito’s services are offered to clinics under a written service agreement; pricing and terms are set out in each clinic’s agreement. Message and data rates from your mobile carrier may apply to any text messages you receive.

Acceptable use

You agree not to use the Site or our messaging program for any unlawful purpose, to send unsolicited communications through our systems, to interfere with the operation of the Site, or to attempt to gain unauthorized access to our systems.

Intellectual property

All content on the Site, including text, graphics, and logos, is owned by or licensed to Vitalito LLC and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute Site content without our prior written consent.

Disclaimers

The Site and our services are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of liability

To the fullest extent permitted by law, Vitalito LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our messaging program.

Governing law

These Terms are governed by the laws of the state where Vitalito LLC is located, without regard to conflict of law principles.
